Entrepreneur Declan Ganley says he is to continue legal action against the State, Denis O’Brien and Michael Lowry after US group Comcast told the High Court it was withdrawing.

Mr Ganley was part of a consortium with US group Comcast which yesterday withdrew from the case and paid the costs of Michael Lowry and made a contribution to the costs of Denis O’Brien.

The case was originally taken by the Comcast consortium following the award of the second mobile phone licence to Denis O’Brien’s Esat Digifone in 1996 while Michael Lowry was Minister for Communications.

The withdrawal by the US group was welcomed by both Denis O’Brien and Michael Lowry yesterday.

Mr Ganley says the case is now under his control.

The Comcast consortium originally included Mr Ganley, Comcast, RTÉ and Bord na Mona.
